TERMS & CONDITIONS

These rules apply equally to all members, temporary members, and guests.

The Club
Any references to ‘The Club’ or ‘Wellness Works’ shall be understood as referring to The Wellness Works LTD, including its staff, employees, subcontractors, agents, and representatives. ‘Facilities’ encompass all services and amenities offered both in-person at our physical locations and remotely via our digital platforms.

Compliance
As a prerequisite of membership, all members must adhere to the following rules. This ensures that the facilities are utilised properly and safely, enabling all members to fully benefit without detracting from the enjoyment of others.

Membership

  1. Eligibility and Non-Transferability: All members must be aged 16 or older to access and use the facilities and services of The Wellness Works. Membership rights are strictly non-transferable and non-refundable.
  2. Admission and Screening: Wellness Works operates as a private members club. Management reserves the right to refuse membership to any individual without cause. In certain circumstances we may request additional information or checks before a membership can be offered.
  3. Membership Terms and Payments:
    • Membership durations are fixed, with minimum periods of 3, 6, or 12 months. Payment must be made for the full term of the contract as agreed upon signup.
    • Under exceptional circumstances, a cancellation fee equivalent to 50% of the remaining contract may be charged at the discretion of the Directors.
    • After the initial period, memberships automatically renew on a rolling basis at the current rate unless cancelled with one month’s notice.
    • After a contract has expired, members may choose to enter into a new fixed term contract to enjoy offers or rates available at the time of purchase.
    • Membership fees are subject to an annual increase on April 1st each year, discretionary increases may be applied at other times in exceptional circumstances.
    • If you take advantage of a membership offer, we may ask for proof of status. If suitable proof cannot be provided, you will be charged the difference between the discounted and standard membership backdated to the beginning of your contract. If there is no contract of the same length as the one that you have signed up for, the standard rate used will be the 3 month contract rate
  4. Freezing of Membership: Memberships of 12 months may be frozen for up to one month during the contract term. Memberships of 3 months and 6 months duration are not eligible for suspension.
  5. Acceptance of Terms: By joining the club, members agree to be bound by these membership conditions.

Payment

  1. Initial and Monthly Payments:
    • Upon selection of a monthly membership option, members are required to pay the associated registration fee (if applicable) and the first month’s membership fee in advance.
    • Monthly payments are due on the same day each month, in the case of Bank Holidays, weekends or other anomalies, payment will be taken on the next working day.
  2. Payment Method:
    • Membership fees will be automatically debited from the member’s designated bank debit/credit card.
    • Requests to change the payment card used can be made at [email protected]
    • When automatic payments failed, other payment methods might be used by Wellness Works for debt recovery
  3. Handling Failed Payments:
    • In the event of a failed payment, the club will reattempt the transaction once at no additional charge. If the second attempt fails, a £20 administrative fee will be levied to cover processing costs.
    • The club reserves the right to suspend or cancel membership until outstanding payments are received. Access to facilities will be restricted during this period but fees are still payable. Should membership be cancelled due to non-payment, the registration fee will be required upon rejoining and any outstanding balance will have to be settled.
  4. Default on Payments:
    • Failure to settle an outstanding balance within 28 days of the due date will result in the member being considered in default. Subsequent to this, the contract may be terminated and recovery actions initiated, which may affect the member’s credit score.
    • It is the responsibility of the member to address any missed payments as a result of collection anomalies.
  5. Update of Contact Information:
    1. Members must maintain current contact details in their customer account to ensure seamless communication, particularly for payment-related matters.
  6. Contract Commitment:
    • Members are advised to select a contract length that aligns with their personal circumstances, including address stability, health, and financial situation.

Facilities and Services

  1. Maintenance and Accessibility:
    • The club reserves the right to temporarily withdraw all or part of its facilities for maintenance or other necessary work for up to seven working days.
  2. Membership Access:
    • Members must scan their membership barcode for access to the building on each visit.
    • Entry is permitted only to those with a valid, current, and paid-up membership. Access will be denied if there are outstanding dues on a member’s account.
  3. Compliance with Club Rules:
    • Members agree to adhere to the club rules regarding the use of facilities, opening hours, and conduct. The club may amend these rules as necessary, provided that members are given advance notice of any changes.
  4. Class Bookings and Cancellations:
    • Members who book a class but fail to attend without prior cancellation may face a suspension of booking privileges for up to 14 days. Cancellations must be made no later than 3 hours before the scheduled class time to allow other members the opportunity to utilise the spot.
  5. Personal Insurance and Liability:
    • Members may, at their own discretion and expense, obtain personal insurance for loss, injury, or damage incurred during the use of club facilities. Members accept that any such injury or illness resulting from exercise is their own responsibility.
  6. Reporting Incidents:
    • Members wishing to report accidents, incidents, or problems with club services should speak with a staff member or email [email protected] confidentially.
  7. Enforcement of Rules:
    • The club reserves the right to deny admission or require any member or guest to leave the premises if they breach membership rules or engage in illegal or inappropriate behaviour, including theft, drug use or antisocial behaviour. Offenders will be permanently banned from re-entry.
  8. Personal Trainer Sessions:
    • Personal training sessions may be conducted by the designated lead personal trainer or a qualified colleague. While Wellness Works cannot guarantee the availability of a specific trainer for every session, the club commits to ensuring all trainers are well-qualified to meet member needs.
  9. Lockers
    • Usage: Lockers are available for member use during visits but must not be used overnight.
    • Liability: Items left in lockers overnight may be removed. The club is not responsible for any loss or damage to items removed from lockers. Members use lockers at their own risk.
    • Security: Padlocks are available for purchase at the reception. Members are encouraged to secure their belongings.
  10. Opening Hours
    • The club reserves the right to adjust opening hours as necessary for optimal operations. Please consult a staff member or visit our website for the most current information.
  11. Guests
    • Members may invite guests by purchasing a “Bring a Friend” pass, which allows for one-time use of the gym and participation in a class within seven days of purchase.

Safety & Hygiene

  1. Health Screenings: Members are advised to undergo regular health and medical screenings with their General Practitioner.
  2. Orientation Sessions: New members must complete a basic introductory session before using the fitness facilities. This session is detailed in the welcome email and must be booked with a club personal trainer.
  3. Attire and Equipment Use:
    • Proper, clean attire and footwear are required in the gym and studio areas.
    • Members and guests must use a hand towel during workouts and are required to clean each piece of equipment after use.
  4. Wellbeing Monitoring: If you experience dizziness, faintness, unusual pain, or feel unwell, cease exercising immediately and inform a staff member.
  5. Injury Reporting: Studio users should notify the instructor of any pre-existing injuries or concerns before class begins.

Liability Disclaimer

  1. Assumption of Risk: Members acknowledge that participation in any exercise program, use of the gym facilities, or engagement in any activity within club premises carries an inherent risk of injuries and other hazards. By accessing the club facilities, members assume all risks associated with such activities.
  2. Release of Liability: Members agree to release, indemnify, and hold harmless The Wellness Works, its directors, officers, employees, and agents from any and all claims, demands, injuries, damages, actions, or causes of action arising out of or connected with the use of any of the club’s facilities or services. This release extends to any loss, damage, or injury that might be caused by negligence of the club, its staff, or other members.
  3. Medical Advice Disclaimer: Any advice or recommendations provided by Wellness Works staff or through club programs does not replace professional medical advice. Members should always consult with their General Practitioner or other health care professional before starting any new exercise regimen or making significant changes to their existing treatment or health care routines.

Website and MyWellness App Usage

  1. General Use:
    • Users must comply with all applicable laws and regulations when using The Wellness Works website and the MyWellness app. The content and services provided through these platforms are intended solely for personal and non-commercial use by our members and guests.
  2. Account Security:
    • Users are responsible for maintaining the confidentiality of their account information, including passwords. It is essential to notify The Wellness Works immediately of any unauthorized use of your account or breach of security.
  3. Accuracy of Information:
    • While The Wellness Works strives to ensure the information on its website and app is accurate and up to date, we cannot guarantee this at all times. Users should verify any information that may affect their decision to use The Wellness Works services.
  4. Prohibited Activities:
    • Users are prohibited from using the website or app to engage in any activity that is illegal, infringes on the rights of others, or is harmful to others, such as transmitting viruses, malicious code, or other harmful files.
  5. Intellectual Property:
    • All content on the website and app, including text, graphics, logos, images, and software, is the property of The Wellness Works or its content suppliers and protected by copyright and intellectual property laws. Users may not use any of this content without express permission from The Wellness Works.
  6. Changes and Availability:
    • The Wellness Works reserves the right to modify, update, or discontinue any aspect of the website or app at any time without prior notice. This includes changes to features, functionalities, and content.
  7. Privacy
    • The use of the website and MyWellness app is also subject to the privacy policy of The Wellness Works, which outlines the collection, use, and protection of personal information.
  8. Limitation of Liability:
    • The Wellness Works will not be liable for any damages arising from the use or inability to use the website or app, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
